SD Medical Cannabis Practitioner Certification

South Dakota's medical cannabis card process begins with the practitioner: once a registered practitioner certifies the patient's debilitating medical condition in the Patient/Caregiver/Practitioner Portal, the patient receives an emailed link to apply for a registry card. The Department cannot process a card application until it has the certification. Reviews typically take 2 to 4 days, and cards are renewed annually.

Who completes it

A physician, physician assistant or APRN with authority to prescribe drugs, licensed in South Dakota (or in a nonresident patient's home state) and registered with the program, completes the whole electronic certification. The patient completes the application that follows.

Submitting and payment

How to submit it
Create a practitioner account and enter the certification in the medical cannabis Patient/Caregiver/Practitioner Portal; the patient then receives an emailed application link to complete and pay.
Who pays
The patient pays the card application fee when applying, with a reduced fee for low-income applicants and added fees for home cultivation or a second caregiver.

Good to know

  • Debilitating conditions listed in SDCL 34-20G include cancer, chronic pain, epilepsy, multiple sclerosis and terminal illness, among others.
  • The Department publishes Account Registration Guidance for Practitioners, a step-by-step guide to setting up the portal account before the first certification.
  • The Department does not keep a list of practitioners willing to certify, and it posts provider education material on its medical cannabis pages.
  • Patients may apply to grow up to two flowering and two non-flowering plants at home; caregivers must be at least 21 and generally assist no more than five patients.

Frequently asked questions

Who can certify a patient for medical cannabis in South Dakota?

Under SDCL 34-20G-1, a physician, physician assistant or advanced practice registered nurse licensed with authority to prescribe drugs to humans. For a nonresident cardholder, the practitioner must hold that authority in the patient's state of residence. Practitioners register for a portal account before certifying.

Why hasn't my patient received the application link?

The emailed application link goes to the patient only after the practitioner submits the certification in the portal, and the Department cannot process an application until it receives that certification. Once the patient applies, the Office of Medical Cannabis typically reviews it within 2 to 4 days, and cards arrive by mail in 4 to 10 days.
