Delaware Medical Marijuana Practitioner Certification

Adults applying for a Delaware medical marijuana card on paper need page 2 of the patient application signed by a Delaware-licensed practitioner. The practitioner chooses a standard or terminal illness patient card and writes in the medical condition(s); since HB 285 (2024) there is no fixed qualifying list. Residents 65 and older may instead self-certify on the same page.

Who completes it

A Delaware-licensed MD, DO, APN or PA completes the entire Health Care Practitioner Certification section, including license details, specialty, identified condition(s) and signature. The patient completes page 1, or self-certifies at the bottom of page 2 if 65 or older.

Submitting and payment

How to submit it
The patient mails the original with the paper application, ID copy and fee so it arrives within 90 days of the practitioner's signature; faxed and electronic copies are refused. Registered practitioners can instead accept online applications from patients seen within 90 days.
Who pays
The patient pays a nonrefundable application fee that varies with the card length chosen: one, two or three years.

Good to know

  • Partial applications are not accepted: the practitioner completes the entire section, prints clearly and identifies the medical condition being certified.
  • Self-certifying patients 65 and older name their own condition and certify under penalty of perjury that they will use medical marijuana for it or for a treatment's side effects.
  • Patients 17 and younger use the separate Pediatric Medical Marijuana Patient Application, which must be certified by a pediatric specialist.

The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

What conditions qualify for a Delaware medical marijuana card?

HB 285 (2024) removed Delaware's list of debilitating conditions. The practitioner identifies any medical condition they believe is likely to benefit, writes it on the certification and selects a standard or terminal illness patient card. Residents 65 and older may self-certify without a practitioner.

How long is a Delaware practitioner certification valid?

The completed application must reach the Medical Marijuana Program within 90 days of the practitioner's signature date. Online applications likewise require a visit with a registered practitioner within the past 90 days. Faxed or electronic copies of the paper certification are not accepted.

Can Delaware nurse practitioners and PAs certify medical marijuana patients?

Yes. The certification accepts a Delaware-licensed MD, DO, APN or PA. The practitioner enters their medical license number, license type and specialty, identifies the patient's medical condition(s) and signs; the license state must be Delaware.
