West Virginia OIC-WC-1: Report of Occupational Injury

West Virginia's workers' compensation claim application pairs the employee's account of an injury with the initial health care provider's report on one form. A clinician meets it at the first treatment for a work injury or occupational disease, since Section II must be completed by the initial provider. The form is filed with the employer's carrier, self-insured employer or TPA, which reviews it and issues a decision approving or denying the claim.

Who completes it

The employee completes Section I (injury date and time, employer and supervisor, body parts, how the injury happened, witnesses) and signs a medical release. The initial treating physician or hospital completes all of Section II and signs the provider certification.

Submitting and payment

How to submit it
The completed form is filed with the employer's private carrier, self-insured employer or third-party administrator. The OIC posts it as a fillable Word document, and the form asks that entries be printed or typed.
Who pays
No fee is printed on the form; medical services on West Virginia claims follow the OIC's maximum allowed reimbursement schedule (West Virginia Medicare rates plus 35%), though private carriers, self-insured employers and approved managed care plans may set their own fees.

Good to know

  • Section II asks whether you advised the patient to stay off work four or more days; the OIC's worker brochure ties temporary total disability to four or more consecutive days, certified by the treating physician.
  • Mark whether the condition directly results from an occupational injury, an occupational disease or a non-occupational condition, and whether it aggravated a prior injury or disease.
  • The diagnosis field on the posted form is still labeled ICD-9-CM and asks for diagnosis codes in order of severity, alongside a written description and the body parts injured.
  • If the patient can return to modified duty, Section II asks for the specific limitations, plus the date the patient may return to work and any referral or hospitalization.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Does the doctor have to complete the West Virginia WC-1?

Yes. Section II states that all information must be completed by the initial healthcare provider. The first physician or hospital to treat the injury enters the initial treatment date, return-to-work date, time off or duty restrictions, cause, body parts, diagnosis codes, any referral and hospitalization, then signs the certification.

What happens after a West Virginia workers' comp claim is filed?

According to the OIC's injured-worker brochure, the claim gets a claim number and a claims adjuster. After review, the worker receives a decision saying whether the claim is approved or denied and which medical conditions are covered. A worker who disagrees can file a written protest with the Workers' Compensation Board of Review within 60 days.

Can the treating physician discuss the claim with the employer?

The OIC brochure explains that by filing a claim, the worker irrevocably agrees that any physician may discuss their medical history and treatment with the employer and the insurer, including prior conditions of the same body part. The WC-1 provider certification also commits you to release office notes and test results immediately to the employer or its representative.
