Kentucky AOC-720A: Involuntary Hospitalization Exam

Kentucky district courts use the AOC-720A when a petition seeks 60-day or 360-day involuntary psychiatric hospitalization under KRS 202A. A clinician meets it after examining the respondent before the final hearing. The sworn certification records whether the respondent has a mental illness, presents a danger, can benefit from treatment, and whether hospitalization is the least restrictive alternative, with supporting facts for each.

Who completes it

A qualified mental health professional completes the whole two-page affidavit, checking one credential from the KRS 202A.011 list printed on page 1. A notary or other official completes the sworn-statement block at the end.

Good to know

  • Two examination certifications, one of them by a psychiatrist, are typically required for the final hearing on a 60-day or 360-day petition.
  • Each of the four findings (mental illness, danger to self, family or others, ability to benefit, least restrictive alternative) is checked yes or no and followed by the facts supporting that belief.
  • The examiner must attest to a good-faith attempt to contact the petitioner for relevant information before completing the examination.
  • Rev. 10-26 cites KRS 202A.011, 202A.051, 202A.056 and 202A.061; companion forms in the same case include AOC-710A, AOC-715A and AOC-730A.

Frequently asked questions

How many AOC-720A certifications does a Kentucky hospitalization hearing need?

Two certifications are typically required for the final hearing on a 60-day or 360-day involuntary hospitalization, and one of the two examiners should be a psychiatrist. Each examiner completes and swears to a separate AOC-720A after their own examination of the respondent.

How does the AOC-720A define least restrictive treatment?

The form describes it as treatment that gives an individual with a mental illness a realistic opportunity to improve their level of functioning, consistent with accepted professional practice, in the least confining setting available. The examiner states whether hospitalization meets that standard and gives supporting facts.

Does the AOC-720A need a diagnosis?

Yes. Item 4 asks for the examiner's diagnostic impression after the four criteria are addressed. The examination date is recorded in item 3 together with the respondent's name, and the form is then signed with the examiner's title before a notary.
