Kentucky AOC-708.3: KRS 202C Examination Certificate

Kentucky circuit courts use the AOC-708.3 in KRS Chapter 202C proceedings, which concern people with an intellectual disability who were found incompetent to stand trial and are considered dangerous. A clinician meets it when the court orders an examination before the commitment hearing. The sworn certificate tells the judge whether the respondent meets the commitment criteria and gives the facts and diagnostic impression behind that opinion.

Who completes it

A qualified mental health professional under KRS Chapter 202C completes the whole two-page affidavit after checking the box for their credential: physician, psychiatrist, licensed psychologist, qualifying psychiatric nurse, social worker, marriage and family therapist, professional counselor or physician assistant. A notary completes the sworn-statement block.

Submitting and payment

How to submit it
The certificate is filed with the circuit court handling the case, and the form instructs examiners to submit it no fewer than seven days before the hearing, excluding weekends and holidays.

Good to know

  • If the examiner finds the respondent does not meet the criteria, only paragraph 3, the date the examination was performed, is completed along with the signature.
  • A finding that the criteria are met covers two points: the respondent presents, or would present if released, a danger to self or others, and any presently available less restrictive treatment would endanger safety.
  • The examiner states the facts supporting each criterion and attaches supporting documentation, then lists up to two diagnostic impressions.
  • The current edition is Rev. 10-26 and cites KRS 202C.030, 202C.050 and 202C.060; related court forms in the same proceeding include AOC-708, AOC-708.2 and AOC-708.5.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Who can complete the Kentucky AOC-708.3?

Any qualified mental health professional under KRS Chapter 202C. The form lists the categories: Kentucky-licensed physicians and psychiatrists, psychologists licensed under KRS Chapter 319, psychiatric nurses with set education and experience, and social workers, marriage and family therapists, professional counselors and physician assistants who meet experience and employment requirements.

How far ahead of the hearing must the AOC-708.3 be filed?

The form says to submit it no fewer than seven days before the hearing, not counting weekends and holidays. The certificate must also be sworn before a notary, so the examination, the written findings and the notarization all have to be finished before that cutoff.

What does the court need from the examiner on the AOC-708.3?

A checked opinion on whether the respondent meets the KRS 202C commitment criteria, the facts behind each criterion with supporting documents attached, a diagnostic impression and the date of the examination. When the criteria are not met, only the examination date is required.
