Kentucky AOC-703A: Casey's Law QHP Certification

Kentucky district courts use the AOC-703A in Casey's Law cases, where a petitioner asks the court to order involuntary treatment for a substance use disorder under KRS Chapter 222. A clinician meets it after being named as an examiner in the court's notice and order (AOC-701A). The sworn certification tells the judge whether the respondent meets the statutory criteria and what treatment the examiner recommends.

Who completes it

A qualified health professional completes the whole affidavit: a qualified mental health professional under KRS 202A.011, an alcohol and drug counselor licensed or certified under KRS Chapter 309, or a Kentucky-licensed physician. A notary or other official completes the sworn-statement block at the end.

Submitting and payment

How to submit it
Each examining professional files a separate AOC-703A with the district court and must certify the findings within 24 hours of the examination. The examination itself must take place no later than 24 hours before the hearing date.
Who pays
The form states that the petitioner is responsible for all costs of the examination.

Good to know

  • A 72-hour treatment order needs one certification; a 60-day or 360-day order needs two qualified health professionals to file separately, and at least one of them must be a licensed physician.
  • The examiner marks does or does not for three findings: a substance use disorder, an imminent threat of danger to self, family or others (or substantial likelihood of one), and benefit from treatment.
  • Narrative items ask for supporting facts, diagnostic impressions, other factors contributing to the need for treatment, the goal of treatment with a recommendation, and the date the examination was performed.
  • Examiners may be subpoenaed for cross-examination at the hearing, which can take place in person, by telephone or by videoconference.

Frequently asked questions

Who can sign the Kentucky AOC-703A?

A qualified health professional as defined in KRS Chapter 222. That covers every qualified mental health professional listed in KRS 202A.011, including physicians, psychiatrists, licensed psychologists, qualifying psychiatric nurses, social workers, therapists, counselors and physician assistants, plus alcohol and drug counselors licensed or certified under KRS Chapter 309. Page 3 of the form reprints the full definitions.

When is the AOC-703A due?

The respondent must be examined no later than 24 hours before the hearing date. Each of the two professionals named in the Hearing, Examination and Appointment of Counsel Notice and Order (AOC-701A) must then certify findings to the court within 24 hours of the examination, each on a separate AOC-703A.

Does the AOC-703A have to be notarized?

Yes. It is a sworn affidavit that closes with a subscribed-and-sworn block where the notary records the county, the date, the commission expiration and a notary ID number. The professional also prints their name, title and the treatment facility they work for next to the signature.
