Medical Assessment for Tutorship or Mandate (Québec)

Before a Québec court can open a tutorship for an adult or homologate a protection mandate, a physician must document the incapacity on this mandatory form. It records the examination, diagnoses, decision-making faculties for the person and for property, risks, the person's wishes and a recommended reassessment time limit. A psychosocial assessment completes the file, and the report is sent only if it finds incapacity.

Who completes it

A physician who has examined the person completes every section and signs Section 8; the Curateur public's fact sheet says all sections must be completed for the form to be admissible in court. A social worker or other authorized professional completes the separate psychosocial assessment.

Submitting and payment

How to submit it
For a public tutorship requested through the Curateur public, send the original to the competent person of the establishment; for a private tutorship or a mandate homologation, send it to the applicant who attested under oath, with a copy to the person concerned. The Curateur public does not accept forms by email.
Who pays
For general practitioners, the medical assessment is provided for in the RAMQ fee-for-service manual (Section B, Letter of Agreement 223), according to the Curateur public's fact sheet for physicians.

Good to know

  • Section 7 must always state a recommended reassessment time limit: no more than five years, or up to ten when the person's condition will clearly not change.
  • For a mandate homologation where the diagnosis predates or coincides with the mandate, Section 4 asks whether you can attest to the person's capacity when they signed it.
  • Older versions are no longer accepted for new evaluations, and the Curateur public asks evaluators to consult its report admissibility verification tool before completing tutorship forms.
  • The Collège des médecins recommends two trainings, available through the FMSQ and FMOQ portals, for physicians using the Curateur public's medical assessment and reassessment forms.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms change without notice, so download the current version from the official page before you fill it in.

Frequently asked questions

Can the medical assessment be based on the chart alone?

No. The Civil Code of Québec requires the physician to examine the person, and the form cannot be completed solely from a file. Section 3 asks for the examination dates, how long you have known the patient, the people consulted, such as relatives or a social worker, and relevant documents.

Does a finding of incapacity remove all of the person's rights?

No. Unless the court decides otherwise, a person under tutorship can still contract for usual needs, perform acts related to their work and manage the proceeds of that work. Section 6 lets you add details on these faculties, and the court may open a tutorship even when homologation was sought.

Is this medical assessment available in French?

Yes. The French title is Évaluation médicale dans le cadre de l'ouverture d'une tutelle au majeur ou de l'homologation d'un mandat de protection. One medical form serves both a tutorship and a protection mandate, while the psychosocial assessment has a separate version for each.
