PEI Mental Health Act Form 9: CTO Renewal

The psychiatrist responsible for a community treatment order uses this form under section 20 of PEI's Mental Health Act to renew it. The form records when the current order was issued and when it expires, the conditions that still apply after a new assessment within the previous 72 hours, and the renewed treatment plan and expiry date.

Who completes it

The responsible psychiatrist completes and signs the whole form, including the supporting facts and the community treatment plan, attached or written in. The substitute decision-maker's consent to the plan is confirmed on the form.

Submitting and payment

How to submit it
The renewal is issued to the person, who must comply with it. The signing psychiatrist stays responsible for supervising and managing the order and may appoint another psychiatrist where necessary.

Good to know

  • Unlike the first order, the renewal doesn't repeat the two-admissions history condition; it rests on a fresh assessment within the previous 72 hours.
  • The person must still have a mental disorder with harm or likely harm, or likely substantial deterioration, and still need community treatment they can't consent to but can comply with.
  • The treatment must still exist in the community and be available, and the substitute decision-maker must consent to the renewed plan.
