PEI Mental Health Act Form 8: Community Treatment Order

A psychiatrist uses this order under section 18 of PEI's Mental Health Act to require a person to follow a community treatment plan. The person must have been admitted involuntarily twice or more in the previous two years for at least 30 days in total, or been on a prior order. The plan is attached or written into the order, which states its own expiry date.

Who completes it

The issuing psychiatrist completes the whole order, including the conditions, supporting facts and the community treatment plan, and signs it. The person's substitute decision-maker consents to the plan; the psychiatrist confirms that consent on the order.

Submitting and payment

How to submit it
The order is issued to the person, who must comply with it. The psychiatrist who signs it is responsible for its supervision and management, and may appoint another psychiatrist to take that on where necessary.

Good to know

  • The psychiatrist must have assessed the person within the previous 72 hours and find a mental disorder with harm or likely harm, or likely substantial deterioration, as a result.
  • The person must need community treatment and be unable to consent to it, but able to comply with an order.
  • The treatment the person needs must exist in the community, be available, and be provided to them.
  • Renewing the order uses Form 9, completed by the responsible psychiatrist before the expiry date written on this order.

Frequently asked questions

Who qualifies for a community treatment order in PEI?

Within the previous two years, the person must have been admitted as an involuntary patient on two or more separate occasions for a total of at least 30 days, or been the subject of a prior order. A psychiatrist's assessment within 72 hours must also meet the order's criteria, and the substitute decision-maker must consent to the plan.

Does a PEI community treatment order need consent?

Yes, from the person's substitute decision-maker. The order applies to a person who is not capable of giving or refusing consent to community treatment but is able to comply with an order, and the psychiatrist confirms that the substitute decision-maker has consented to the community treatment plan on the person's behalf.
