Ohio Probate Form 26.1: Certificate of Physician

Ohio probate courts use Standard Probate Form 26.1 when a petitioner seeks court-ordered involuntary treatment for alcohol and other drug abuse under Casey's Law, R.C. 5119.92 and 5119.93. A clinician meets it when asked to examine the respondent named in the petition. The physician states whether the respondent has alcohol or drug abuse, presents a danger, and can benefit from treatment, and recommends a type and length of treatment.

Who completes it

A physician as defined in R.C. Chapter 4731 who examined the respondent completes the whole two-page certificate, including the facilities list on the reverse, and signs with their license number.

Submitting and payment

How to submit it
The petitioner files the completed certificate with the petition in the county probate court.

Good to know

  • The physician recommends inpatient or outpatient treatment and a length of treatment, then lists on the reverse treatment providers known to be willing and able to provide it.
  • Danger findings cover an imminent danger or threat of danger to self, family or others if not treated, or a substantial likelihood of such a threat in the near future.
  • If the respondent refuses to be examined, the related Form 26.2, Affidavit of Refusal of Examination, is used; the current 26.1 edition took effect July 1, 2016.

The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.
