MAID Clinician Aid D-1: Waiver of Final Consent

This Ontario clinician aid is the written arrangement between a patient and the physician or nurse practitioner who will provide MAID, waiving the Criminal Code requirement for express consent immediately before MAID is provided. It applies only when natural death is reasonably foreseeable and the patient may lose capacity before a specified date. It is not valid until every other safeguard is met, including two independent eligibility assessments.

Who completes it

The MAID physician or nurse practitioner completes Section 3, initials the Section 4 terms and any Section 5 additional terms with the patient, and signs the Section 7 confirmation. The patient, or an authorized person signing in their presence and under their direction, completes Sections 1, 2 and 6.

Submitting and payment

How to submit it
The form has no submission address: it is the written arrangement itself, and it may be completed at the same time as Clinician Aid B when the practitioner completing Aid B will provide MAID.

Good to know

  • Both the patient and the practitioner initial each Section 4 term; if any term is not agreed by both, the form is considered invalid.
  • MAID will not be provided if the patient shows refusal or resistance by words, sounds or gestures; involuntary reactions to contact, such as twitching at needle insertion, do not count.
  • Additional terms can allow MAID before the specified date in set circumstances, or name other practitioners who personally assessed the patient as eligible and agreed to the arrangement.
  • The waiver is voluntary, is not required to receive MAID, creates no obligation for the practitioner, and the patient can withdraw it at any time.
