Ontario Form 1: Application for Psychiatric Assessment

A physician who has personally examined someone within the past seven days uses this Mental Health Act form to apply for that person's psychiatric assessment in Ontario. The physician completes Box A, the serious harm test, or Box B, for people incapable of consenting to treatment who meet the specified criteria, recording their own observations and facts from others. It authorizes apprehension within 7 days and detention in a psychiatric facility for up to 72 hours.

Who completes it

The examining physician completes and signs the whole form, including the date and time of signing. At the psychiatric facility, the attending physician notes when detention begins and must promptly give the person a Form 42.

Submitting and payment

How to submit it
There is no agency submission step on the form: once signed, it authorizes apprehension and detention, and its final section is completed at the psychiatric facility when detention begins.

Good to know

  • Box A's past or present test covers threatened or attempted bodily harm to self, violence or causing fear of harm to others, or a lack of competence to care for oneself.
  • Box A's future test requires a mental disorder likely to result in serious bodily harm to the person or another person, or serious physical impairment of the person.
  • Box B requires all of its criteria, including prior treatment with clinical improvement, incapacity to consent to treatment with substitute decision-maker consent, and the same or a similar mental disorder.
  • The physician must have made careful inquiry into all the facts needed to form the opinion, and records their own observations separately from facts communicated by others.
