Ontario Mental Health Act Forms for Physicians

Ontario's Mental Health Act sets out statutory forms that physicians complete for involuntary psychiatric assessment and admission, renewals, status changes, capacity certificates and community treatment orders. The most used are Form 1 (application for psychiatric assessment), Form 3 (involuntary admission), Form 4 (renewal), Form 21 (incapacity to manage property), Form 42 (notice of a Form 1) and Form 45 (community treatment order).

Who completes it

Physicians complete these forms: the examining physician signs Form 1, the attending physician signs Forms 3, 4 and 21, and the physician issuing or renewing a CTO signs Form 45. Other forms in the set, such as Form 2 and Form 50, are completed by others, including justices of the peace and rights advisers.

Submitting and payment

How to submit it
Notices drive the process: Form 1 leads to a Form 42, Forms 3 and 4 to a Form 30 notice, Form 21 to a Form 33, and Form 45 to a Form 46, while Form 21 itself goes to the Public Guardian and Trustee.

Good to know

  • Form 1 authorizes apprehension within 7 days of signing and detention for up to 72 hours, and the physician must have examined the person within the past seven days.
  • A Form 3 certificate is valid for 14 calendar days, including the day it is signed; continuing involuntary status needs a Form 4 renewal.
  • A Form 45 community treatment order is in force for 6 months and requires rights advice, a community treatment plan and consent from the person or their substitute decision-maker.
  • The Central Forms Repository lists about 40 Mental Health Act forms; most physician forms are 00/12 editions, while Form 21 was updated in 2022/12.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms change without notice, so download the current version from the official page before you fill it in.

Frequently asked questions

Where are Ontario's Mental Health Act forms published?

In Ontario's Central Forms Repository, in English and French, as fillable PDFs and, for some forms, HTML versions. Each form has its own number, for example 6427-41 for Form 1 and 3760-41 for Form 45, and searching Mental Health Act in the repository lists the full set.

Which Mental Health Act forms trigger rights advice?

Form 3 requires the physician to give the patient a Form 30 notice and notify a rights adviser, and Form 21 requires a Form 33 notice and a rights adviser. Before a Form 45 community treatment order is issued, the person and any substitute decision-maker must receive rights advice.

Which forms does a patient use to challenge a decision?

Applications to the Consent and Capacity Board use Board forms such as Forms 16, 18 and 48, which are completed by the patient or someone on their behalf, not by the physician. Form 45 itself tells the person they may apply to the Board using Form 48.
