Ontario Form 42: Notice of Application for Assessment

This Mental Health Act notice tells a person in Ontario that a physician has applied for their psychiatric assessment under section 15, or that the Minister has ordered their custody under section 32. It restates the grounds certified, explains that the application allows the hospital to hold them for up to 72 hours, and tells them they may retain and instruct a lawyer without delay.

Who completes it

The attending physician completes and signs the notice. Part I covers a physician's Form 1 application, with Part A and/or Part B completed, and Part II covers a Minister's order under section 32.

Submitting and payment

How to submit it
Form 42 is delivered to the person: Form 1 instructs the attending physician to give it promptly once detention at the psychiatric facility begins and to record the date and time it was delivered.

Good to know

  • Part A of the notice mirrors Form 1's Box A serious harm test, and Part B mirrors Box B for people incapable of consenting to treatment.
  • Both parts tell the person they have the right to retain and instruct a lawyer without delay.
  • Part I names the physician who examined the person, the date of that examination and the grounds certified in the Form 1 application.
  • Part II applies only when the Minister has ordered custody in a psychiatric facility for up to 72 hours under section 32 of the Act.
