Nova Scotia IPTA Form 9: Community Treatment Order

A psychiatrist uses this form to place a Nova Scotia patient on a community treatment order, so treatment or care and supervision continue outside a psychiatric facility. It combines the order, with all five subsection 47(3) criteria, and the section 48 community treatment plan naming the providers, obligations and a back-up psychiatrist. The order lasts up to 180 days unless renewed or terminated.

Who completes it

The attending psychiatrist completes the order and plan and signs in front of a subscribing witness, who also signs. The psychiatrist confirms the substitute decision-maker's consent has been requested and will be obtained before the order takes effect.

Submitting and payment

How to submit it
The completed form is filed with the designated Nova Scotia Health or IWK office managing IPTA health records and with the provincial IPTA Review Board administration. Copies go promptly to the patient, the substitute decision-maker, the chief executive officer and everyone with obligations under the plan.

Good to know

  • Within the preceding two years the person must have been detained in a psychiatric facility for 60 days or more in total, or on two or more occasions, or been on a previous order.
  • The Act requires the psychiatrist to have examined the person within the immediately preceding 72 hours, and the form records the date, time, location and method of that examination.
  • Issuing a community treatment order terminates any existing declaration of involuntary admission for that person, under subsection 47(7) of the Act.
  • The patient must submit to prescribed treatment and attend scheduled appointments; the psychiatrist must notify everyone on the plan of any change to it.

Frequently asked questions

How long does a Nova Scotia community treatment order last?

Section 51 of the Act says a community treatment order expires 180 days after the day it is made unless it is renewed under section 52 or terminated earlier. The form records the start date and the expiry date, 180 days after signing.

What must the community treatment plan include?

Section 48 requires a plan of treatment, conditions on treatment or care and supervision, the obligations of the person and of any substitute decision-maker, the supervising psychiatrist, all persons or organizations that agreed to provide care and their obligations, and a named replacement psychiatrist.

Does the substitute decision-maker have to consent?

Yes. Clause 47(3)(b) requires the order to state that the substitute decision-maker has consented. The form has the psychiatrist confirm that consent has been requested and will be obtained before the patient is placed on the order and before its effective date.
