Nova Scotia IPTA Form 4: Involuntary Admission

After conducting an involuntary psychiatric assessment, a psychiatrist on the staff of a Nova Scotia facility uses this declaration to admit the person as an involuntary inpatient. It records the examination dates and methods, all five section 17 criteria including lack of capacity to make admission and treatment decisions, the reasons and sources relied on, and an expiry date no more than 30 days away.

Who completes it

The psychiatrist who conducted the involuntary psychiatric assessment completes and signs the declaration, names the psychiatric facility and checks a box confirming the patient and substitute decision-maker were told of the right to legal counsel.

Submitting and payment

How to submit it
The Act requires filing with the chief executive officer or designate, and the form directs filing with the designated Nova Scotia Health or IWK office that manages IPTA health records. A completed declaration requires transfer to a designated psychiatric facility.

Good to know

  • The capacity criterion requires assessing whether the person can, with or without support, understand their condition, the proposed treatment, and the risks and benefits of having or refusing it, and appreciate foreseeable consequences.
  • An attending psychiatrist can also use a declaration of involuntary admission to change a voluntary patient's status to involuntary under section 25 of the Act.
  • A psychiatrist must complete a written, individualized treatment plan within 30 days of the declaration, and the patient and substitute decision-maker receive a copy.
  • The Review Board reviews each involuntary patient's file, with a deemed application 60 days from the initial declaration and at set stages after that.

The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

How long does a Nova Scotia declaration of involuntary admission last?

Clause 22(a) of the Act allows detention, observation and examination for not more than 30 days under a declaration of involuntary admission. The psychiatrist enters an expiry date on the form no later than 30 days after the date signed; continuing requires a Form 5 renewal.

What must happen after Form 4 is filed?

The chief executive officer must examine the declaration immediately, deliver a copy to the patient and substitute decision-maker, and promptly inform them in writing of the reasons for admission, the Review Board's function, the right to apply for review, the right to counsel and the other section 26 rights.

Is Form 4 available in French?

The province's forms page posts the IPTA forms in English only. French versions are offered for the factsheets explaining the Act, the Review Board, the Patient Rights Advisory Service and substitute decision-makers, not for the forms themselves.
