Yukon Form 7: Certificate of Involuntary Admission

Two physicians use this Mental Health Act certificate to admit a person to hospital in Yukon as an involuntary patient after an involuntary psychiatric assessment. Each physician examines the patient and completes a separate copy within 24 hours of the patient's arrival at hospital, recording findings, a diagnosis and the grounds for admission. The form states the certificate is valid for 21 days only.

Who completes it

Each of the two examining physicians completes and signs their own copy of the whole form, with a witness signature. The patient and family receive copies but complete nothing on this certificate.

Submitting and payment

How to submit it
Both copies go to the Capability and Consent Board and the Chief Executive Officer of Whitehorse General Hospital. The patient receives both copies with blank Forms 8 and 9, and the nearest relative, proxy or guardian, if available, receives both copies with a blank Form 9.

Good to know

  • Option B lets each physician record a diagnosis and then choose release, voluntary admission, or involuntary admission when the disorder is likely to cause serious bodily harm or impending serious mental or physical impairment.
  • Involuntary admission also requires the physician to give evidence that the patient is not suitable for admission as a voluntary patient.
  • Under section 14 of the Act, one or both certifying physicians must prepare a care and treatment plan within 120 hours of completing the certificates.
  • Section 30 of the Act requires the Capability and Consent Board to review every involuntary admission within seven days of receiving the certificates.

Frequently asked questions

How long does a Yukon Certificate of Involuntary Admission last?

The form states the certificate is valid for 21 days only, matching section 13 of the Mental Health Act, which allows detention, observation and examination for up to 21 days. Continuing involuntary status past that point requires a Certificate of Renewal, Form 11, completed by the attending physician and one other physician.

Why do two physicians complete Form 7?

Section 13 of the Act allows admission as an involuntary patient only when the physicians who examined and assessed the person each complete and file a certificate. The form requires two separate copies, each with its own examination findings, information sources and grounds, completed within 24 hours of the patient's arrival.

What forms go to the patient with Form 7?

The patient receives both copies of the certificate together with a blank Form 8, Waiver of Right to an Automatic Hearing, and a blank Form 9, Application to the Capability and Consent Board. The nearest relative, proxy or guardian also receives both copies and a blank Form 9.
