NB Form 2.1: Involuntary Admission Application

The attending psychiatrist uses this application to ask a tribunal to order that a person be admitted to a psychiatric facility as an involuntary patient. It covers someone held under a Form 1 examination certificate, someone held under a judge's order for examination, or a voluntary patient whose status needs to change. If the tribunal grants the order, it authorizes detention for one month.

Who completes it

A psychiatrist practising in New Brunswick who has observed, examined and assessed the person completes the whole form, including the two-part examination report, and signs it with the date and hour. No other party completes a section.

Submitting and payment

How to submit it
Where the person is detained under an examination certificate or a judge's order, the form says the application must be filed with the chair of the tribunal having jurisdiction within 72 hours after detention. The footer also directs that the signed form be sent immediately to Psychiatric Patient Advocate Services.
Who pays
The April 2026 New Brunswick Physicians' Manual lists Medicare service code 9386, MHA completion of other forms, limited to one per patient per day and billable in addition to codes 321, 322 and 331.

Good to know

  • All four opinions must be stated: serious mental illness, recent behaviour showing likely serious harm or substantial mental or physical deterioration, unsuitability for voluntary status, and that less restrictive alternatives would be inappropriate.
  • The examination report separates facts observed by the psychiatrist from facts communicated by others, then describes the nature or degree of the illness and the reasons relied on for the diagnosis.
  • For a voluntary patient, section 12 requires the psychiatrist to tell the patient the reasons and the right to retain and instruct counsel without delay, and the administrator notifies the nearest relative in writing.
  • A tribunal order authorizes detention for one month after the order date. Continuing detention past that point requires Form 12, the first certificate of detention.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

What is the deadline for filing Form 2.1 in New Brunswick?

When the person is detained under a Form 1 examination certificate or a judge's order for examination, the application must be filed with the chair of the tribunal having jurisdiction within 72 hours after detention. Filing authorizes the administrator to keep the person detained until the tribunal decides the application.

Can a family physician complete Form 2.1?

No. The form is completed by the attending psychiatrist, a psychiatrist practising in New Brunswick who has observed, examined and assessed the person. A physician who is not a psychiatrist can issue Form 1, the examination certificate, which brings the person to a psychiatric facility for that assessment.

Is there a French version of Form 2.1?

Yes. Formule 2.1, Demande d'admission d'une personne à titre de malade en placement non volontaire, is posted as a separate French PDF. Each version records whether the patient or client chose English or French for completion of the form.
