NB Form 1: Examination Certificate (Mental Health Act)

A New Brunswick physician uses this certificate under section 7.1 of the Mental Health Act after examining someone who may be suffering from a serious mental illness requiring hospitalization for their own safety or the safety of others. Once issued, it lets a peace officer take the person to a psychiatric facility within seven days, where the administrator may detain them for up to 72 hours for observation, examination and assessment.

Who completes it

Any physician practising in New Brunswick who personally examined the person completes and signs the whole certificate, including the date and hour of signing. No one else completes a part; a psychiatrist at the facility then examines the person as soon as reasonably possible.

Submitting and payment

How to submit it
The form states that, once completed and signed, it must be sent immediately to Psychiatric Patient Advocate Services by fax or email. The signed certificate is also the authority a peace officer uses to take the person into custody and to a psychiatric facility.
Who pays
The April 2026 New Brunswick Physicians' Manual lists Medicare service code 9385, MHA completion of Form 1, in its psychiatry section, billable in addition to service codes 321, 322 and 331.

Good to know

  • The certificate is not effective unless the physician signs and issues it within seven days after examining the person, and the examination date is written on the form.
  • Facts the physician personally observed are recorded in section A, separately from facts communicated by others in section B, which asks for the names and addresses of those people.
  • The physician must also state that the person is not suitable for admission as a voluntary patient. The Act's definition of serious mental illness excludes an intellectual disability.
  • If the attending psychiatrist decides after assessment that involuntary admission is needed, they file Form 2.1 with the tribunal chair within 72 hours of the person's detention.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.
