Texas Form 3019 Infant Sleep Exception (Child Care)

Texas child care minimum standards require infants to sleep on their backs in a crib, never in restrictive devices or swaddled. When a health care professional decides it is medically necessary for an infant to sleep in another position, in a device such as a bouncer seat or swing, or swaddled, this form documents the exception so the child care operation can follow it.

Who completes it

The parent completes the infant's information and signs the waiver of liability. The infant's health care professional describes the medical condition, the sleep position, device or swaddling technique and effective dates, and signs; an official of the child care operation signs last.

Submitting and payment

How to submit it
The completed form goes to the child care operation through the parent, which keeps it in the infant's classroom while the exception is active.
Who pays
The form sets no fee and does not address payment for the health care professional's recommendation.

Good to know

  • The exception is not effective until all sections and signatures are complete; then the operation may use it.
  • Centers follow minimum standards 746.2426 to 746.2428 and licensed or registered homes follow 747.2326 to 747.2328 on infant sleep; the form documents a medical exception to those rules.
  • The parent confirms receiving the operation's safe sleep policy and releases it from liability for harm due to SIDS.
  • Form 3019 (04/2018) comes in English and Spanish and is a fillable form that HHSC says may need to be opened in desktop Adobe Reader rather than a browser.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

What can a Texas infant sleep exception allow?

Form 3019 can allow an alternative sleep position other than on the back, sleep in a restrictive device such as a bouncer seat or swing, or swaddling for sleep, when the infant's health care professional determines it is medically necessary and describes how to do it.

Why won't Texas Form 3019 open in my browser?

It is an interactive Adobe form. Browser PDF viewers may show only a 'Please wait' message, and HHSC notes that some of its forms must be opened in the desktop Adobe Reader application instead of a browser viewer.

Is Texas Form 3019 available in Spanish?

Yes. HHSC lists Form 3019, Infant Sleep Exception/Health Care Professional Recommendation, in English and Spanish on its child day care regulation forms page, along with the related Form 2550, Operational Policy on Infant Safe Sleep.
