OSHA Beryllium Written Medical Opinion for Employer

OSHA's beryllium standard requires a licensed physician to send the employer a written medical opinion after each beryllium medical surveillance exam. Its content is strictly limited by 29 CFR 1910.1024(k)(6), and anything about exposure limits, chronic beryllium disease (CBD) referral, continued surveillance or medical removal needs the employee's written authorization. OSHA publishes no form for it.

Who completes it

The licensed physician who performed or directed the beryllium surveillance exam writes the whole opinion. A separate written medical report, with fuller results, goes to the employee under 1910.1024(k)(5).

Submitting and payment

How to submit it
The employer must obtain the opinion within 45 days of the exam, including any follow-up BeLPT, and must give the employee a copy within the same 45 days.
Who pays
The employer pays; beryllium medical surveillance must be provided at no cost to the employee.

Good to know

  • Without authorization, the opinion contains only the exam date, a statement that the exam met the standard, respirator or PPE limitations, and that results were explained to the employee.
  • With the employee's written authorization, it may add exposure limits, a CBD diagnostic center referral, continued periodic surveillance and a medical removal recommendation.
  • Surveillance exams, including a BeLPT, are due at least every two years for covered employees, plus a termination exam unless one was done in the prior six months.
  • Construction employers follow the parallel beryllium standard at 29 CFR 1926.1124, which has the same written opinion requirement.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

What happens after the opinion recommends a CBD diagnostic center?

Once the employer receives an opinion recommending referral, it must provide an evaluation at a chronic beryllium disease diagnostic center within 30 days, at no cost to the employee. Testing can include pulmonary function tests, bronchoalveolar lavage and transbronchial biopsy. The referral appears in the employer's opinion only with the employee's written authorization.

Can the beryllium opinion include a medical removal recommendation?

Yes, but only with the employee's written authorization and when the employee is confirmed positive or has CBD. Medical removal lets an eligible employee move to comparable work below the action level, or stay and use a respirator, with earnings and seniority protected for up to six months.
