OSHA Silica Written Medical Opinion for Employer

After each respirable crystalline silica surveillance exam, the PLHCP must give the employer a written medical opinion within 30 days. OSHA's non-mandatory Appendix B to 29 CFR 1910.1053 includes a sample form for it, one of three sample documents alongside the employee's written medical report and an authorization form. Its content is limited unless the employee signs that authorization.

Who completes it

The examining physician or other licensed health care professional (PLHCP) completes and signs the whole opinion, attesting that the exam met 1910.1053(h) or 1926.1153(h). The employee signs only the separate authorization form.

Submitting and payment

How to submit it
The PLHCP gives the opinion to the employer within 30 days of the exam; the employee receives a separate written medical report within the same period.
Who pays
The employer pays; silica medical surveillance is provided at no cost to the employee.

Good to know

  • Without authorization, the opinion is limited to the exam date, a statement that the exam met the standard, and any respirator limitations.
  • With the employee's written authorization, it may also recommend limits on silica exposure and referral to a specialist; either or both may be authorized.
  • Exams with physical, spirometry and a B-read chest X-ray repeat every three years; a reading of 1/0 or higher calls for specialist referral.
  • OSHA posts the sample opinion only as an image in Appendix B; construction employers use the matching Appendix B to 29 CFR 1926.1153.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Why does the silica opinion need the employee's authorization?

OSHA's silica rules made the employer opinion more confidential than earlier standards. Unless the employee signs the written authorization, the employer learns only the exam date, that it met requirements and respirator limitations. The PLHCP should explain the consequences of signing or not signing so the employee can choose.

What happens after a specialist referral in the silica opinion?

If the authorized opinion recommends a specialist, the employer must make an exam by a Board Certified Specialist in Pulmonary Disease or Occupational Medicine available within 30 days after receiving the opinion. A chest X-ray B reading of 1/0 or higher is one finding that calls for referral.
