CMS-1771: Attending Physician Statement, Emergency

A non-participating hospital that admits a Medicare patient in an emergency uses this statement to support payment for the emergency inpatient or outpatient services. It gives the reviewing physician the facts: when the emergency occurred, where the patient was first seen, admitting signs and symptoms, emergency services provided, why the patient remained an emergency case, and the earliest date transfer or discharge was medically permissible.

Who completes it

The hospital enters the patient's name and claim number in Section A. The attending physician completes Section B, items 1 to 11, and signs with M.D. or D.O. credentials, the date and contact details.

Submitting and payment

How to submit it
The hospital sends it to the Medicare contractor with the emergency services claim. A copy of the chart, with at least the admission history and physical, nursing notes, physician orders, progress notes and discharge summary, may be sent with or instead of the form.

Good to know

  • Item 4 quotes Medicare's definition: services needed to prevent death or serious impairment of health that require the most accessible hospital equipped to furnish them.
  • If the admission followed a change in a chronic condition, item 6 asks for the acute changes, plus vital signs, level of consciousness and pertinent lab findings.
  • Do not list elective procedures or surgery in item 7. Item 8 must justify the patient remaining an emergency case for the entire period claimed.
  • The form is the 1977 edition, CMS-1771 (9-77), OMB 0938-0023, posted as a fillable PDF. CMS estimates about 15 minutes to complete it.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Can I send the chart instead of completing CMS-1771?

Yes. The form says a copy of the patient's chart, including at minimum the admission history and physical, admission nursing notes, all physician orders, progress notes and the discharge summary, may be submitted in addition to or instead of the form, if it covers all the information requested.

What counts as a Medicare emergency on CMS-1771?

Inpatient and outpatient hospital services necessary to prevent the death or serious impairment of the patient's health which, because of that threat, require the most accessible hospital equipped to furnish them. Item 5 asks whether special equipment or personnel at the admitting hospital was a factor.

Why does CMS-1771 ask for the earliest transfer date?

Item 9 asks for the earliest date it was medically permissible to transfer the patient to a participating hospital or extended care facility, or to discharge them. Item 8 lists the findings, complications or special services that kept the patient an emergency case until then.
