CM-787 Physician's/Medical Officer's Statement (DOL)

DCMWC sends this statement to a black lung beneficiary's physician when it must decide whether someone else should receive and manage the benefits as a representative payee. Based on an examination within the past year, the physician gives an opinion on whether the patient can manage benefit payments in their own interest and describes the findings, diagnosis and type of impairment behind that view.

Who completes it

The patient's physician or medical officer completes the statement and signs the certification. DOL fills in the identifying case information, and the patient does not complete any part.

Submitting and payment

How to submit it
Return it through DCMWC's C.O.A.L. Mine Portal or by mail in the envelope DOL provides, as soon as possible.
Who pays
The form does not mention a fee, and the physician's response is voluntary, though DOL asks for cooperation.

Good to know

  • Answer item 1 Yes, No or Undetermined. Yes or Undetermined requires only items 2 and 3; No requires items 2 through 5 before signing and dating.
  • DOL treats a beneficiary age 18 or older as incapable when they depend on others to protect their interests and meet daily needs such as food, clothing and shelter.
  • Base the opinion on an exam within one year of completing the form; if you have not examined the patient in that time, answer as many items as you consider advisable.
  • Item 5 asks for the name, address, phone and relationship of anyone who has assumed responsibility for the patient or shows an active interest in their welfare.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

What happens after I answer No on CM-787?

A No answer means you believe the patient cannot manage benefit payments. You then complete items 2 to 5: findings, diagnosis, mental or physical impairment, onset date, last exam date, whether the inability will continue, and who looks after the patient. If DOL finds the patient incapable, it normally appoints a representative payee.

Is a physician required to complete CM-787?

No. The form says you are not required to respond, but your cooperation helps DOL decide whether having the patient's funds managed by another party is in the patient's best interest. DOL weighs your answers together with other evidence it receives.

What kinds of impairments does DOL have in mind on CM-787?

The instructions give examples such as severe intellectual disability present since birth, senility or forgetfulness from advancing age, schizophrenia and other mental health problems, and physical impairments so severe that the beneficiary cannot manage funds or direct others to manage them.
