Oregon DWDA Consulting Physician's Compliance Form

Oregon's Death with Dignity Act requires a consulting physician to confirm the attending physician's findings. This one-page form records the consultant's report: that the patient has a terminal disease, has six months or less to live, is capable, is acting voluntarily and has decided after being fully informed. It also records the consultant's view on the patient's mental status and any referral.

Who completes it

The consulting physician completes Sections A to E, checking each determination and signing with name, address and date. The attending physician makes the same determinations on their own compliance form.

Submitting and payment

How to submit it
Deliver the completed form to the attending or prescribing physician, who attaches it to the attending physician's compliance form and sends both to OHA within 7 calendar days of writing the prescription.

Good to know

  • Both the attending and consulting physicians must independently determine terminal disease, a prognosis of six months or less, capability, voluntariness and an informed decision.
  • Section D is required: state the patient has no psychiatric or psychological disorder or depression causing impaired judgment under ORS 127.825, or name the evaluating provider.
  • Section A records whether the patient is an out-of-state resident. The printed revision is 03/24, and OHA advises checking for the current version.
  • The form defines capable as able to make and communicate health care decisions, including through persons familiar with the patient's manner of communicating.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Does the Oregon consulting physician send the form to OHA?

No. The form instructs the consultant to deliver it to the attending or prescribing physician. The attending physician then sends it to the OHA Center for Health Statistics with their own compliance form and the patient's written request, within 7 calendar days of writing the prescription.

What if the Oregon consulting physician suspects depression?

Section D requires a choice. If the consultant cannot state that the patient has no psychiatric or psychological disorder, or depression, causing impaired judgment, they record a referral for evaluation, naming the psychiatric consultant and date. That consultant then completes the Psychiatric/Psychological Consultant's Compliance Form.
