DC Death with Dignity Consulting Physician Compliance

The DC Death with Dignity Act requires a second physician to examine a patient requesting covered medication. The consulting physician uses this form to record the diagnosis, prognosis and examination date, confirm terminal disease, capacity, voluntariness and an informed decision, and state whether the patient was referred for psychiatric or psychological evaluation. The attending physician uploads it in DC Health's portal.

Who completes it

The consulting physician completes the consultant's report, the mental status determination and the consultant's information, and signs with a DC license number.

Submitting and payment

How to submit it
Send the completed form to the attending physician, who uploads it in the DC Health Death with Dignity portal; the PDF version is an instructional sample.

Good to know

  • The consultant must check one mental status statement: no disorder causing impaired judgment, or a referral to a named psychiatric or psychological consultant with discipline and date.
  • An informed decision means the patient was told the diagnosis, prognosis, risks, potential result and alternatives including comfort care, hospice care and pain control.
  • Capable is defined on the form as having the ability to make and communicate health care decisions to health care providers.
  • Residency is affirmed by the attending physician only, so the consulting form does not ask the consultant to confirm it.

Frequently asked questions

Who receives the DC consulting physician's compliance form?

The form is addressed to the attending physician. DC Health's sample forms are for instruction only; the attending physician records the consultation in the online Death with Dignity module and uploads the consultant's form there, along with the date the consultation was requested.

What must the DC consulting physician determine?

The consulting physician must determine that the patient has a terminal disease, is capable, is acting voluntarily and has made an informed decision. The physician also records the medical diagnosis, prognosis and examination date, and whether a referral was made for a possible disorder causing impaired judgment.
