Vermont Patient Choice Consulting Physician Report

Under Vermont's Patient Choice at End of Life law (18 V.S.A. Chapter 113), the prescribing physician refers the patient to a second physician for medical confirmation. This one-page Department of Health form records that consultation: the patient's name and date of birth, the referring physician, four confirmations, and the consultant's attestation that the Act's requirements have been met to the best of their knowledge.

Who completes it

The consulting physician completes the whole form, printing their name, phone number and mailing address in Section D and signing the attestation. Section B names the referring or prescribing physician, who receives the finished form.

Submitting and payment

How to submit it
Deliver the completed form to the attending or prescribing physician, who mails it to the Vermont Department of Health, Vital Records. The consultant does not send it to the Department directly.
Who pays
The Department of Health's forms and compliance rule set no fee or billing code for this report.

Good to know

  • Section C has four checkboxes: diagnosis and prognosis confirmed, the patient is capable, the patient is making an informed decision, and the request for medication is voluntary.
  • The form defines capable as able to make and communicate health care decisions to a physician, including through persons familiar with the patient's manner of communicating.
  • Companion forms are the prescriber's Physician Reporting Form and the Prescribing Physician Follow up Form, which the Department's rule requires after the patient's death.
  • The current version carries a 02.15.2024 date in its footer and is posted on the Department's Patient Choice and Control at End of Life page.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Vero is not affiliated with, or endorsed by, the agencies and insurers listed here. Read our editorial policy.

Frequently asked questions

Is the Vermont consulting physician form mandatory?

The Department of Health says use of its Patient Choice forms is not mandatory; they are provided to help patients and physicians meet the law's mandatory reporting requirements. The determinations themselves are still required: the form notes that both the attending and consulting physicians must confirm diagnosis and prognosis, capability, an informed decision and a voluntary request.

Who sends the consulting physician form to the Vermont Department of Health?

The prescribing physician. The form tells the consultant to deliver it to the attending or prescribing physician, who mails it to the Department's Vital Records office. The Department reviews the filed forms and links them to build a complete patient and physician record of each event.
