NJ MAID Consulting Physician Compliance Form (MAID-5)

Under New Jersey's Medical Aid in Dying for the Terminally Ill Act, a consulting physician must confirm the attending physician's findings before a patient qualifies. Form MAID-5 records that the consultant examined the patient and records, confirmed the terminal diagnosis in writing, judged the patient capable, voluntary and informed, and explained the diagnosis and prognosis. It becomes an attachment to the attending physician's compliance filing.

Who completes it

The consulting physician who determined whether the person was a qualified terminally ill patient completes and signs the two-page form, including the attending physician's details and the patient's terminal condition.

Submitting and payment

How to submit it
Deliver the completed form to the attending physician, who appends it to the Attending Physician Compliance Form and files it with the Office of the Chief State Medical Examiner no later than 30 days after the patient's death.

Good to know

  • The consultant does not file directly; the form reaches the state only as an attachment to the attending physician's MAID-7 filing.
  • If the consultant thinks the patient may not be capable, they must notify the attending physician in writing and refer the patient to a mental health care professional.
  • When a referral was made, the mental health professional's name, facility, address and license number go in a dedicated section on page 2.
  • The form is numbered MAID-5, carries revision marks of August 2019 and October 2021, and cites the Medical Aid in Dying Act, P.L.2019, c.59.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.
