West Virginia DMV-41-SB: Safety Belt Waiver

West Virginia drivers whose physical disability prevents appropriate use of a safety belt can carry this physician-certified waiver under WV Code 17C-15-49(b). The physician describes the disability, explains why belt restraint is inappropriate, marks the certification permanent or temporary, and describes any alternate restraint required. DMV does not certify or keep copies, so the driver keeps the waiver.

Who completes it

The driver completes Part I. A licensed U.S. physician examines the driver, completes and signs Part II, and returns the form to the driver.

Submitting and payment

How to submit it
Nothing is filed with DMV; the physician returns the completed waiver to the driver, who must carry it whenever driving and show it to a law enforcement officer if stopped.

Good to know

  • A temporary certification needs a start and end date for the waiver period; a permanent certification does not.
  • Because DMV retains no copy, drivers are told to keep additional copies in case they lose the original.
  • The waiver serves as an exemption only when completed in full and signed by a U.S. licensed physician, and officers may verify the information on it.

Frequently asked questions

Who can sign a West Virginia safety belt waiver?

Part II must be completed by a licensed U.S. physician who has examined the driver and certifies a physical disability that prevents use of a safety belt under WV Code 17C-15-49(b). The physician gives a medical license number and its expiration date, business details and signature.

Does the West Virginia safety belt waiver expire?

The physician marks it permanent or temporary. A temporary waiver lists the period it covers, from one date to another. The driver must carry the waiver every time they drive and present it to a law enforcement officer if stopped.

Does the physician send DMV-41-SB to the DMV?

No. West Virginia DMV does not certify or retain any copies of safety belt waivers. The physician completes Part II and returns the form to the driver, who keeps the original and any extra copies.
