Pennsylvania MH 790: AOT Plan

Pennsylvania courts that order assisted outpatient treatment (AOT) receive the MH 790, which sets out the services the person will receive. A clinician meets it when an AOT petition (MH 789) or a Section 304 or 305 petition (MH 785) recommends AOT and the court needs a written plan by the hearing date. The plan lists required and optional services, providers, medications and goals.

Who completes it

A qualified professional or treatment team director develops the plan. Only the examining physician, CRNP or physician assistant completes the medication section, and a psychiatrist or licensed clinical psychologist reviews, approves and signs it.

Submitting and payment

How to submit it
The plan goes to the court with the AOT petition (MH 789) or MH 785, before or on the day of the AOT hearing.

Good to know

  • Case management or Assertive Community Treatment (ACT) is required in every court-ordered AOT plan; case management can be dropped only when ACT is recommended.
  • Optional services include psychiatric supportive treatment, medications, therapy, peer support, financial services, housing or supervised living, and co-occurring substance use treatment.
  • The person must be offered a chance to help develop the plan, and the form asks whether they took part and whether others they named could participate.
  • Substance use disorder treatment details are protected under 71 P.S. 1690.108 and 42 CFR 2.64; without consent, a separate court authorization is needed before disclosure.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Who can complete the medication section of the MH 790?

Only the examining physician, a certified registered nurse practitioner or a physician assistant, and only when medication management is recommended in the plan. The section lists all medications, whether self-administered or given by a provider, with provider contact information.

Does the AOT plan need a psychiatrist's signature?

Yes. The signature page states that the plan must be reviewed by a psychiatrist or licensed clinical psychologist before it is submitted to the court. The reviewer records their name, credentials and license number and confirms they reviewed and approved it.

When is the MH 790 due?

The AOT plan must be provided to the court before or on the day of the AOT petition hearing. When an examiner recommends AOT on the MH 789 or MH 785, preparing the plan is part of the examiner's obligation.
