GC-335: Capacity Assessment, CA Conservatorship

In a California probate conservatorship, this declaration records a clinician's capacity assessment of the proposed conservatee and submits it to the court under oath. It covers general physical and mental health, deficits in specific mental functions, and, as the petitioner requests, capacity to consent to specified or general medical treatment, a secured-perimeter dementia facility, or dementia medications.

Who completes it

The petitioner completes items 1 and 2, checking which capacity questions to answer and identifying the person. A California-licensed physician or licensed psychologist completes the rest and signs under penalty of perjury; no notary is needed.

Submitting and payment

How to submit it
Return the completed declaration to the petitioner or attorney, who files it in the court's confidential folder before the hearing. Secure or destroy your copy of the petition rather than sending it to the court.

Good to know

  • Part II rates each mental function from a (no deficit) to d (major deficit or no function), with e for not applicable or not assessed.
  • Item 4 asks psychologists to confirm they practice within scope and whether they have at least two years' experience diagnosing major neurocognitive disorders such as dementia.
  • Item 19 can refer to the optional Everyday Activities Attachment (GC-335A) for detail on daily living and instrumental activities.
  • Retitled and restructured effective January 1, 2025, replacing the Capacity Declaration. Form GC-334, an ex parte order, lets the clinician release information for the assessment.
