DHCS 1809: California Additional 14-Day Certification

When a person already in 14-day intensive treatment in California presents an imminent threat of taking their own life, the treating facility uses this notice to certify them for up to 14 more days under Welfare and Institutions Code section 5260 and following. It states the facts behind the allegation, names who signed the supporting affidavits, and lists services the person would not accept.

Who completes it

Two signers representing the intensive treatment facility, typically the professional person in charge and the treating physician or psychologist, complete and sign the notice. The affidavits it relies on accompany it.

Submitting and payment

How to submit it
File the original with the superior court and personally deliver a copy to the person certified. Copies go to the person's attorney, the public defender, the district attorney and the facility providing intensive treatment.

Good to know

  • The signers state that the person received a copy and was clearly advised of the continuing right to judicial review by habeas corpus, with the term explained.
  • The certification runs for no more than 14 days, beginning on the date entered, in the intensive treatment facility named on the form.
  • Revised 12/2019, a one-page fillable form also known as MH 1761, marked confidential patient information. DHCS posts it in English only.
  • It follows the initial 14-day certification on DHCS 1808, which also covers the separate additional 30 days for grave disability.
