CARE-101: Mental Health Declaration, CARE Act

This declaration supports a CARE Act petition (CARE-100) in California superior court with a licensed behavioral health professional's view on whether the respondent meets the diagnostic criteria. The clinician states they examined the respondent within 60 days of filing, or tried and was refused, then explains each criterion: qualifying psychotic disorder, severity, stabilization status, and likely benefit from a CARE plan.

Who completes it

A California-licensed physician, psychologist, clinical social worker, marriage and family therapist, professional clinical counselor, nurse practitioner or physician assistant completes items 1 to 8 and signs under penalty of perjury. A professional granted a DHCS licensure waiver may also sign.

Submitting and payment

How to submit it
The declaration is attached to the CARE Act petition (CARE-100) and filed with the superior court. It is a confidential, mandatory Judicial Council form.

Good to know

  • Both the examination and any unsuccessful examination attempts must fall within 60 days of the petition's filing; describe each attempt and the respondent's response in item 6.
  • A qualifying diagnosis is a schizophrenia spectrum or other psychotic disorder in the same class, or bipolar I disorder with psychotic features, excluding psychosis from current intoxication.
  • Psychosis due to a medical condition such as traumatic brain injury, autism or dementia does not qualify, and neither does a substance use disorder alone.
  • Current edition Rev. July 1, 2026, four pages. CARE-050-INFO is the related information sheet for CARE Act proceedings.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Who can sign the CARE-101?

A licensed behavioral health professional for whom the examination is within the scope of license: a California physician, psychologist, clinical social worker, marriage and family therapist, professional clinical counselor, nurse practitioner or physician assistant. Someone granted a licensure waiver under Welfare and Institutions Code 5751.2 may also sign.

What if the respondent will not cooperate with the exam?

Check item 5b and list the dates you attempted the examination, then explain in item 6 how many attempts were made, what kind, how the respondent responded and the outcome of each. Item 7 still asks why you have reason to believe the criteria are met.

Is CARE-101 available in Spanish?

The Judicial Council posts translations in Spanish, Chinese, Korean, Vietnamese, Khmer, Farsi and Tagalog for information only. The mandatory form is the English CARE-101, revised July 1, 2026, which is filed with the petition.
