Minnesota GAC 115: Physician's Statement

Minnesota district courts receive this statement in guardianship and conservatorship cases. The respondent's attending physician records the exam date, a diagnostic impression, the behavioral evidence supporting the petition, the diagnosis and prognosis, and an opinion on whether the person needs a guardian or conservator for their person, their estate or both. A second part covers inability to attend the hearing.

Who completes it

The respondent's attending physician completes and signs the whole two-page statement, including how long they have been the person's physician. The petitioner files it with the petition (GAC 2) in the district court case.

Submitting and payment

How to submit it
The physician signs and returns the statement to the petitioner, who files it with the district court under the case's court file number. The court posts it as a PDF to print and as a DOCX to fill in on a computer.

Good to know

  • Item 4 asks whether the physician knows of a health care directive, living will or similar document executed in another state and enforceable in Minnesota, with details if so.
  • The hearing part is completed only if the person is physically unable to attend. It names the hearing date and has its own attending physician signature.
  • The opinion in item 3 has separate boxes for help with care of the person and management of the estate, so the physician can address guardianship, conservatorship or both.
  • The current version is GAC 115 State ENG Rev 11/25, a statewide form. The court visitor's report (GAC 21) is a separate filing in the same case.

Frequently asked questions

Who completes the Minnesota GAC 115?

The respondent's attending physician, who states how long they have been the person's physician and the date of the examination. The physician describes the diagnostic impression, behavioral evidence, diagnosis and prognosis, gives an opinion on the need for a guardian or conservator, and signs with name and contact details.

Can the GAC 115 excuse the respondent from the hearing?

The second part of the form lets the attending physician state that, because of the medical condition described in the statement, the person is unable to attend the hearing set for a given date. It is completed only when the person is physically unable to attend, and the court makes the decision.

Does the GAC 115 ask about advance directives?

Yes. Item 4 asks whether the physician is aware of a health care directive, a living will, or a similar document executed in another state and enforceable under Minnesota law. If the physician knows of one, the form asks for additional information about it.
