Colorado DR 2538: Medical Hardship Late Fee Exemption

Colorado waives the late fee on a vehicle registration renewal when medical care, treatment or incapacitation kept the owner from renewing on time, under C.R.S. 42-3-112(1.5)(a) and DMV Rule 44. The owner completes page 1 of DR 2538, and a medical professional certifies on page 2 the period during which the owner was under care or incapacitated.

Who completes it

The vehicle owner completes page 1 (owner and vehicle information) and signs the affidavit. A medical professional completes page 2, the Medical Professional Certification, with name, license number, address, the beginning and ending dates of the hardship, and a signature.

Submitting and payment

How to submit it
The owner submits the affidavit with the registration renewal at the county motor vehicle office.

Good to know

  • The form tells the medical professional not to include HIPAA-protected information or any details of the care, treatment or incapacitation; only the dates are needed.
  • The certification covers care that kept the person from completing titling, registration, a temporary registration permit or a renewal within the statutory time.
  • Both the owner and the medical professional sign under penalty of perjury in the second degree.
  • The current version is DR 2538 (03/07/25), published 03/31/25, a 2-page fillable PDF from the Colorado DMV.
