QME Form 121: Protection of Mental Health Record

When a California evaluator or treating provider judges that letting an injured worker see or copy a mental health record is likely to cause significant adverse medical consequences, this declaration under Health and Safety Code 123115(b) and 8 CCR 36.5 is attached to the record. The employee's copy then goes to a physician or provider the employee designates.

Who completes it

The licensed provider completes and signs the declaration under penalty of perjury, giving license type and number, the medical basis for the conclusion and how the employee's request was handled.

Submitting and payment

How to submit it
Attach it to the mental health record served on the parties; the employee's copy is served on the physician or health care provider the employee designates, not on the employee.
Who pays
The form does not address fees.

Good to know

  • The provider must tell the employee the record can be inspected or copied only by a licensed physician (Labor Code 3209.3) or health care provider (Health and Safety Code 123105) acting for them.
  • Item 7 records whether the provider declined inspection and copies only, or also declined personal service and served the designated provider, with date and manner of service.
  • From then on the provider notes in the file each time a physician or provider asks to inspect or copy the record; page 2 has a log for this.
  • The restriction can cover the whole record or only the portions designated on the form and on the face of the record.
