NL MHCTA-01: Certificate of Involuntary Admission

This Mental Health Care and Treatment Act form holds both certificates needed to admit a person as an involuntary patient in Newfoundland and Labrador. A physician or nurse practitioner completes the first certificate after a psychiatric assessment, and a psychiatrist completes the second. With both signed, the person is promptly admitted to a psychiatric unit and may be detained for up to 30 days.

Who completes it

A physician or nurse practitioner completes the First Certificate page; a psychiatrist completes the Second Certificate, or another physician if a psychiatrist is not readily available. Each signer records the assessment address, time and date and the person's MCP number.

Submitting and payment

How to submit it
The form's copy line lists the original, the patient, the patient representative and the administrator. The psychiatric unit's administrator must notify a rights advisor when each certificate for an involuntary patient is filed.

Good to know

  • Each certifier must have personally assessed the person within the immediately preceding 72 hours and must keep facts they observed separate from facts others communicated.
  • The criteria are a mental disorder with likely harm, substantial deterioration or serious impairment unless detained, inability to appreciate the disorder or decide on treatment, and need for care only a psychiatric unit provides.
  • The first certificate alone authorizes apprehension, conveyance and up to 72 hours' detention for assessment; that apprehension authority expires seven days after the first certificate is completed.
  • The second certificate records the date and time of arrival at the second facility, and a rights advisor must meet the person within 24 hours of becoming an involuntary patient.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Can a nurse practitioner sign the NL certificate of involuntary admission?

Yes, for the first certificate. Subsection 17(2) of the Act allows a physician, nurse practitioner or other person authorized by the regulations to complete the first certificate. The second must be completed by a psychiatrist, or by a different physician when a psychiatrist is not readily available.

How long can a person be held on MHCTA-01?

Once both certificates are complete, section 28 allows detention in a psychiatric unit for up to 30 days from the date the first certificate was completed and signed. Before that period ends, the attending physician reassesses the patient and either completes MHCTA-02, the Certificate of Renewal, or ends involuntary status.

How does the form define mental disorder?

The form's footnote quotes section 2 of the Act: a disorder of thought, mood, perception, orientation or memory that impairs judgment or behaviour, the capacity to recognize reality, or the ability to meet the ordinary demands of life, and for which psychiatric treatment is advisable.
