Louisiana 1009 Disputed Claim for Medical Treatment

When a Louisiana carrier denies a 1010 request for treatment, approves it with modifications, or fails to answer within five business days, the aggrieved party can ask the OWCA Medical Director to review the decision on this form. It is also how a party seeks a variance from the Medical Treatment Schedule. Disputes over compensability or causation are not handled here.

Who completes it

The aggrieved party completes the form: the employee, the employee's attorney, or the health care provider, marked in item 7. The requesting party signs and prints their name.

Submitting and payment

How to submit it
File it with OWCA Medical Services by email, fax or mail within 15 calendar days of the 1010 denial, modified approval or deemed denial, and send the same packet to the carrier or self-insured employer that day.
Who pays
The form does not mention a filing fee or any payment terms.

Good to know

  • Attach a copy of the 1010 and everything sent to the carrier (LAC 40:I.2715(J)), any denial letter from the carrier or utilization review company, and scientific evidence when seeking a variance.
  • A deemed or tacit denial occurs when the carrier or self-insured employer does not return the 1010 within five business days of submission.
  • Compensability and causation disputes are not addressed by the Medical Director and go on Form 1008 instead.
  • Revised 08/2025. The OWCA downloads index lists it as Medical Guidelines Dispute; requests missing required records may be rejected.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

How long do I have to file a Louisiana 1009?
