Texas ERS 2.12 Attending Physician Statement

Texas state employees applying to ERS for occupational or non-occupational disability retirement need a medical doctor to complete this notarized statement, part of the Disability Retirement Packet. It covers diagnoses written out in words, history, findings, six-month progress, activity and environmental limits, and whether the condition is likely to permanently incapacitate the patient for state employment and for other occupations.

Who completes it

Only a Doctor of Medicine or Doctor of Osteopathic Medicine may complete the statement, and the signature must be witnessed by a notary public. The member completes ERS 2.11, and the employing agency completes the ERS 2.221 Departmental Statement.

Submitting and payment

How to submit it
The original notarized form is mailed to ERS with the member's application and medical records; notarized forms may not be faxed. ERS must receive all forms by the requested retirement date.
Who pays
The patient is responsible for charges for completing the form, including medical records or copies.

Good to know

  • ERS does not accept ICD codes: each diagnosis must be written out, with onset date, cause and first and last exam dates where known with reasonable medical probability.
  • ERS assumes the patient can perform any activity or tolerate any environmental factor left unchecked, so every relevant limit should be marked.
  • Question 12 asks whether the opinion on work capacity rests solely on the patient's own opinions regarding disability.
  • Use N/A for questions that do not apply and initial beside any correction; ERS does not accept incomplete or illegible forms. Current revision 02/2014.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Can a nurse practitioner complete ERS 2.12?

No. Only a Doctor of Medicine or Doctor of Osteopathic Medicine is authorized to complete the Attending Physician Statement for an ERS disability retirement application, and that doctor lists clinic affiliation, primary specialty and medical school graduation date.
