FMCSA Seizure Exemption: Physician Letter

Interstate commercial drivers with epilepsy or another condition likely to cause loss of consciousness can apply to FMCSA for an exemption from 49 CFR 391.41(b)(8). There is no fill-in form: the application letter lists what the treating physician's statement must say, and FMCSA publishes each application in the Federal Register for 30 days of public comment before deciding.

Who completes it

The driver's treating physician writes a statement on letterhead dated within 3 months of submission and supplies recent visit notes. The driver adds a license copy, a 3-year driving record, an applicant statement and a signed medical release form.

Submitting and payment

How to submit it
The driver sends the complete application to FMCSA's Seizure Exemption Program by email, mail or fax, using only one method, and FMCSA notifies the driver of its decision in writing.

Good to know

  • If the driver takes no anti-seizure medication, the letter must give the date it was stopped or confirm it was never taken.
  • FMCSA's criteria: epilepsy needs 8 seizure-free years, a single unprovoked seizure 4 years, and any anti-seizure regimen should be unchanged in drug, dose and frequency for 2 years.
  • A copy of the DOT physical does not satisfy the visit-note requirement; FMCSA wants the treating physician's most recent exam notes with history, labs, diagnostic tests and medications.
  • The driving record must be dated within 3 months of the application, with crash reports or citations for any crash or moving violation.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

What must the physician letter for an FMCSA seizure exemption include?

On letterhead and dated within 3 months: the diagnosis, the date of the last seizure (month and year, or year), current anti-seizure medications with dose and frequency, the date of the last change to each, and a sentence stating the physician supports the applicant driving a CMV in interstate commerce.

How often must drivers with a seizure exemption be recertified?

FMCSA's criteria call for recertification every year for drivers with an epilepsy diagnosis and every 2 years for drivers with a single unprovoked seizure. FMCSA posts a separate renewal application that asks for the same treating physician letter.

Is a provoked seizure treated differently?

Yes. FMCSA weighs low-risk causes, such as a medication, head injury with loss of consciousness of 30 minutes or less, or alcohol withdrawal, against moderate-to-high-risk causes such as penetrating head injury, brain tumor or stroke. Drivers with moderate-to-high-risk factors should be seizure-free for 8 years.
