NC DMH 5-72-19-2: 24-Hour Facility IVC Exam

North Carolina 24-hour facilities record the second examination of an involuntary commitment respondent on DMH 5-72-19-2, printed on the form as the Second Examination for Involuntary Commitment. A clinician meets it after the respondent arrives following a first examination or emergency certificate. The examiner decides whether the respondent still meets commitment criteria and recommends a disposition to the court.

Who completes it

A physician completes the inpatient and outpatient second exam and must not be the physician who did the first exam or signed the emergency certificate. For substance abuse commitment, a qualified professional may sign if a physician performed the first exam; the facility's record custodian certifies the copy.

Submitting and payment

How to submit it
Copies go to the clerk of superior court where the petition began, the clerk where the facility is located, the respondent or attorney and the proposed outpatient provider; if the clerk cannot receive them within 48 hours, the examiner phones in the findings. IVC filings go through eCourts in all North Carolina counties.

Good to know

  • Section I has three columns (inpatient, outpatient, substance abuse) with criteria checkboxes; Section II must describe findings for every criterion checked.
  • Disposition options include inpatient commitment for a stated number of days, outpatient or substance abuse commitment, release pending hearing, holding at the facility, voluntary treatment or termination.
  • A respondent charged with a violent crime and found incapable of proceeding is not released until the court orders it, even if criteria are not met.
  • The exam may be done by telehealth if the physician certifies the results match an in-person exam; the current revision is dated 3/13/2024.
