Florida CF-MH 3130: Involuntary Outpatient Petition

Florida facility administrators file this petition to ask the circuit court to order involuntary outpatient treatment. A psychiatrist's first opinion must allege and substantiate each of eight criteria, including adult age, mental illness, treatment noncompliance and prior involuntary admissions or serious violence within 36 months, and a second qualified examiner confirms them.

Who completes it

The administrator of the receiving or treatment facility completes the petition pages. A psychiatrist signs the First Opinion; a psychiatrist or clinical psychologist signs the Second Opinion, or in counties under 50,000 a physician or psychiatric nurse if the administrator certifies it is necessary.

Submitting and payment

How to submit it
File it with the clerk of the circuit court within the 72-hour examination period, within two court working days of transfer to involuntary status, before an inpatient order expires, or while an inpatient petition is pending.

Good to know

  • Each criterion on page 3 must be substantiated by evidence, and less restrictive alternatives must be judged inappropriate after contact with named programs or agencies.
  • The proposed treatment plan goes on CF-MH 3145. A guardian advocate petition is attached when one is needed for mental health or medical decisions.
  • Both examiners must have personally examined the person within 72 hours of signing their opinions.
  • Recommended Word form printed 'Nov 11'. It still says 'placement', although the statute now uses 'involuntary outpatient services'.
