Florida CF-MH 3032: Involuntary Inpatient Petition

A Florida receiving facility files this Baker Act petition when it seeks a court order for involuntary inpatient services. The administrator's petition is supported by two expert opinions, each based on a personal examination within 72 hours, finding mental illness, refusal of or inability to decide on voluntary placement, and a risk of harmful self-neglect or serious bodily harm, with less restrictive alternatives judged inappropriate.

Who completes it

The facility administrator or designee completes the petition pages. A psychiatrist signs the First Opinion; a psychiatrist, clinical psychologist, or in some cases a licensed physician or psychiatric nurse signs the Second Opinion.

Submitting and payment

How to submit it
The facility files it with the clerk of the circuit court within the 72-hour examination period (the next court business day if that ends on a weekend or holiday), or within two court business days after transfer to involuntary status.

Good to know

  • A licensed physician with postgraduate mental health training, or a psychiatric nurse, may give the second opinion only if the administrator certifies that no psychiatrist or clinical psychologist is available.
  • Each opinion lists the programs or agencies contacted in judging less restrictive alternatives inappropriate, and the observations that support it.
  • If a guardian advocate is needed, attach the petition on CF-MH 3106. The clerk sends copies to the individual, guardian, public defender, representative, state attorney and DCF.
  • Word form dated August 2025, under Rule 65E-5.290, F.A.C. The 2024 Baker Act rewrite replaced 'placement' with 'services' in the title.
