Florida CF-MH 3101: Hospital Release Determination

When a person under a Baker Act involuntary examination is brought to a hospital that is not a designated receiving facility for an emergency medical condition, a physician or clinical psychologist there can conduct the examination and record on this form that the person does not meet criteria for involuntary inpatient placement or involuntary outpatient services. The examiner then offers voluntary placement or approves direct release.

Who completes it

A physician or licensed clinical psychologist recognized by the hospital as eligible to perform involuntary examinations completes and signs the whole form, with license number, date and time.

Submitting and payment

How to submit it
Keep the completed form, or its equivalent, in the clinical record. A Notice of Release or Discharge (CF-MH 3038) goes to the individual, any guardian, anyone who executed a certificate, and any court that ordered the examination.

Good to know

  • The examination must include observations of recent behavior, review of the initiating and transportation forms, a brief psychiatric history and a face-to-face examination.
  • Check at least one reason from each category: why inpatient criteria under s. 394.467 and outpatient criteria under s. 394.4655 are not met.
  • Outpatient reasons include being under 18, ability to survive safely without supervision, and no involuntary admission or serious violence within the preceding 36 months.
  • CF-MH 3101 (July 2023), Rule 65E-5.280, F.A.C. When the person instead needs examination at a receiving facility, the hospital uses CF-MH 3102.

Hospital Determination that Individual Does Not Meet Involuntary Placement Criteria

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Who can sign CF-MH 3101?

A physician or licensed clinical psychologist whom the hospital recognizes as eligible to perform the involuntary examination. The examiner personally examines the person, signs with their license number, and records the date and time of the examination.

What has to happen before release under CF-MH 3101?

The examiner documents recent behavior, reviews the initiating and transportation forms, takes a brief psychiatric history and examines the person face to face. After release, the hospital sends a Notice of Release or Discharge (CF-MH 3038) to the person, guardian, certificate signers and any ordering court.

Can the examiner offer voluntary admission instead of release?

Yes. The form has two options: offer voluntary placement to the individual, or approve direct release from the hospital. Either way, the examiner first records why the person does not meet the inpatient and outpatient involuntary criteria.
