Vermont Application for Emergency Exam (DMH)

In Vermont, the emergency examination of a person believed to be in need of treatment under 18 V.S.A. section 7504 begins with this application, captioned in the Superior Court, Family Division. A clinician meets it when acting as the applicant, often alongside a physician's first certification. The application sets out observed and reliably reported facts showing why the person needs an emergency examination and hospitalization.

Who completes it

The applicant completes the whole form and signs it. The form notes that only a law enforcement officer or a mental health professional (physician, psychologist, social worker, mental health counselor, nurse or other qualified person designated by the Commissioner of Mental Health) may apply for a warrant for an emergency examination.

Submitting and payment

How to submit it
The application travels with the person to the hospital, with the warrant or the physician's certificate, and a copy is faxed or securely emailed to the Vermont Psychiatric Care Hospital (VPCH) Admissions Office.

Good to know

  • Ten sections cover personal information, where the assessment happened, familiarity with the person, mental status, dangerous behavior, eyewitnesses, neurological issues, substance use, criminal history and need for hospitalization.
  • Applicants must separate current from historical information, and the form warns that illegible writing may lead the court to discharge the person before they are properly treated.
  • It is signed under the penalties of perjury under 18 V.S.A. section 7612(d)(2); the current version is the 2026 update, also posted as a Word file.
