Delaware Pharmacy Justification Form (Workers' Comp)

Delaware's workers' compensation pharmacy rules use a preferred drug list. When a prescriber wants an injured worker to get a non-preferred or brand-name medication, this one-page justification lets the pharmacist dispense it. It asks whether the prescription monitoring program was checked, the current or previous preferred drugs, the non-preferred drug selected and whether symptoms were controlled on the prior regimen.

Who completes it

The physician or other authorized prescriber completes and signs it, certifying compliance with the pharmacy regulations in 19 DE Admin Code 1341, section 4.13.

Submitting and payment

How to submit it
The prescriber gives the form to the injured worker with the prescription, and the worker gives it to the pharmacist.
Who pays
The form sets no fee; once it is completed, the pharmacist must dispense the non-preferred or brand-name drug.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.
