Kentucky Form 108-OD: Occupational Disease Report

Kentucky occupational disease claims, including coal workers' pneumoconiosis and other lung or heart diseases, use this report in litigation before administrative law judges. The physician documents complaints and smoking history, employment history from Form 104, treatment, examination, testing with ILO-classified chest x-rays and pulmonary function tests, diagnosis, AMA Guides impairment, work-related causation, restrictions and treatment recommendations.

Who completes it

A treating or evaluating physician, including a university evaluator, completes sections A through L and signs the L certification, attaching a CV or giving a Physician Index Number.

Submitting and payment

How to submit it
The party offering the report files it in the claim through the Litigation Management System.
Who pays
The form sets no fee and does not say who pays for the report.

Good to know

  • For pneumoconiosis, use ILO classification and attach the ILO form for chest x-rays; report pulmonary function tests before and, if indicated, after bronchodilator.
  • Measure height in centimeters without shoes; if the result is an odd number, use the next higher even number.
  • Item A6 marks the purpose of the exam: treatment, an evaluation requested by a named party, or a university evaluation.
  • The regulation incorporates this October 2016 edition; the forms index still lists an older Form 108 for CWP revised April 2005.

How this list is checked

A form is listed only after its name and number were confirmed on the issuing agency’s or insurer’s own website, or in the form itself. Each entry links to that source. The list was last checked in October 2026. Forms and their requirements change without notice, so check the official page for the current version before you complete one.

Frequently asked questions

Does Form 108-OD cover black lung claims in Kentucky?

Yes. The October 2016 Form 108-OD covers coal workers' pneumoconiosis through ILO classification of chest x-rays, with the ILO form attached. An older Form 108 for CWP still appears on the forms index, but the regulation now incorporates only this edition.

What causation questions does Form 108-OD ask?

Section I asks whether, within reasonable medical probability, the disease is causally related to the work environment, whether any pulmonary impairment is caused in part by workplace factors such as coal dust or chemicals, and which factors are involved and how they relate to the diagnosis.
