Texas DWC069: Report of Medical Evaluation (MMI/IR)

In Texas workers' compensation, a doctor certifies maximum medical improvement (MMI) and assigns any permanent impairment rating on this report. The certifying doctor states whether the employee reached clinical or statutory MMI and gives the rating with the AMA Guides edition used, backed by a narrative. When someone other than the treating doctor certifies, the treating doctor marks agreement or disagreement on the same page.

Who completes it

The certifying doctor completes Parts I to V: a treating doctor, a doctor acting in the treating doctor's place, a DWC designated doctor, or a DWC-approved carrier-selected RME doctor. The treating doctor completes Part VI when another doctor certifies.

Submitting and payment

How to submit it
File it with the narrative report no later than the seventh working day after the exam or receipt of needed records, whichever is later, by fax or electronic transmission to the carrier, treating doctor, DWC, employee and representative.
Who pays
A doctor not authorized by 28 TAC 130.1 to file the report will not be paid for the report or for the MMI and impairment examination.

Good to know

  • Only a DWC-certified doctor, or one with specific DWC permission, may assign an impairment rating; an uncertified doctor can only find no impairment and certify MMI.
  • Statutory MMI is the later of the end of the 104th week after temporary income benefits began or a date extended by DWC; the MMI date cannot be prospective.
  • A finding of no impairment is not the same as a 0 percent rating, which requires the examination and testing the AMA Guides call for.
  • Keep the original report and narrative and records of the exam date, when and from whom records arrived, and how each copy was delivered.

Frequently asked questions

Who can file DWC Form-069 in Texas?

Only a doctor serving as the treating doctor, a doctor selected by the treating doctor to act in its place, a DWC-selected designated doctor, or a carrier-selected RME doctor approved by DWC after a designated doctor exam, under 28 TAC 130.1. Certification by an unauthorized doctor is invalid.

How long does an injured employee have to dispute a DWC069 rating?

The form tells employees that a first certification of MMI or impairment rating must be disputed within 90 days after written notice is delivered, by requesting a designated doctor or a benefit review conference through DWC. Otherwise the certification may become final.
