Delaware Paid Leave CSHC: Provider Certification

Delaware Paid Leave medical and family caregiver claims cannot be decided until the health care provider completes this online Certification of Serious Health Condition in Delaware LaborFirst. It asks just three questions: whether the condition meets the FMLA definition of a serious health condition, how many weeks the employee should take off, and whether reduced-schedule or intermittent leave applies.

Who completes it

The health care provider of the claimant, or of the family member the claimant will care for, completes it; staff can complete it on the provider's behalf using the claimant's access code.

Submitting and payment

How to submit it
After filing in Delaware LaborFirst, the claimant receives an access link and code and shares them with the provider, who completes the certification online within 30 calendar days of claim submission. There is no paper version.

Good to know

  • No diagnosis, records or HIPAA-protected details are requested. If the answer to the first question is no, the other two questions do not appear.
  • Leave schedules are continuous, intermittent (counted in full days, unlike FMLA hours), reduced hours per day or reduced days per week; the provider does not set the work schedule.
  • Medical leave and family caregiver leave each allow up to six weeks every two years, within a combined maximum of 12 weeks in a 12-month period.
  • Employers with approved private plans may use their administrator's own forms, such as Unum's CL-1359-DE, instead of the state certification.

Frequently asked questions

How long does a provider have to complete the Delaware CSHC?

The certification must be completed within 30 calendar days from the date the claim was submitted. If it is not completed, the claim cannot move forward into adjudication. The claimant is responsible for giving the provider the LaborFirst link and access code and may ask for status updates.

What does the Delaware CSHC ask health care providers?

Three questions: whether the illness or injury meets the FMLA definition of a serious health condition, how many weeks the employee should take off, and whether the leave qualifies as reduced-schedule or intermittent. Providers are never asked for a diagnosis or supporting materials such as EKGs or X-rays.
