FMLA Form WH-385-V: Veteran Military Caregiver Leave

When an employee requests FMLA military caregiver leave to care for a covered veteran, the employer can ask for this certification. The veteran's health care provider confirms the injury or illness was incurred or aggravated in the line of duty on active duty and identifies which of four qualifying categories applies, such as a VA service-related disability rating of 50 percent or higher.

Who completes it

The employer or employee fills in Section I and the employee or veteran Section II (discharge date and type, branch, rank and unit); the veteran's health care provider completes Section III, Parts A to C.

Submitting and payment

How to submit it
Return the completed form to the patient or employee for the employer; never send it to the Department of Labor. The employer must allow at least 15 calendar days for its return.

Good to know

  • The four categories: continuation of an in-service serious injury or illness, a VASRD rating of 50 percent or higher, a service-related condition impairing gainful work, or VA Family Caregiver program enrollment.
  • Employers must accept documentation of the veteran's enrollment in the VA Program of Comprehensive Assistance for Family Caregivers in place of this form.
  • The provider may rely on determinations from an authorized DOD or VA representative for military-related questions, and genetic test information must not be included.
  • It covers veterans within five years of discharge; current servicemembers use WH-385, and if no category applies the employee may need WH-380-F.

How this list is checked

Frequently asked questions

What is the difference between WH-385 and WH-385-V?

WH-385 certifies the serious injury or illness of a current servicemember in the Regular Armed Forces, National Guard or Reserves. WH-385-V is for a covered veteran and asks for discharge details and which of four veteran categories applies, such as a VA disability rating of 50 percent or more.

Can a VA disability rating support form WH-385-V?

Yes. One qualifying category is a physical or mental condition for which the veteran has a VA Service Related Disability Rating of 50 percent or higher, based in whole or in part on the condition that creates the need for military caregiver leave. The provider may rely on VA representative determinations.
